Título: Como o novo Código Florestal (Lei nº 12.651/2012) afeta o desmatamento no município de Boca do Acre - AM

Abstract: The law 12.651/2012 which replaced the Law 4.771/1965 and instituted the " newest " Brazilian Forest Code, sparked controversy about the justification used for the modification, doubts about the ability to protect the forests and, on its applicability . To understand the implications and reasons for change and estimate potential future environmental and social consequences, this dissertation was being structured in three chapters: the first one is a literature review on the history of the Forest Code, of its creation until the last substitution occurred in 2012; the second on the demarcation of permanent preservation areas (APPs) on the edge of watercourses, and the ecological and social consequences of the new legal definitions of these areas, in the municipality of Boca do Acre , Amazonas; the third, creates a modeling of deforestation in Boca do Acre until 2025 using 3 scenarios, being considered two counterfactuals whose premises the total prohibition of deforestation within the permanent preservation areas on the banks of watercourses according to the two versions of the legislation (1965 Forest Code and 2012 Forest Code) and baseline scenario that follows current trends regarding deforestation rates within these areas. The results showed that historically the Forest Code has always been linked to economic interests and that the law 12.651/2012 emerged aiming to legalize irregularities . In fact the new legislation reduces the protected areas and thereby reduces the environmental liabilities in permanent preservation areas by 24% in the municipality of Boca do Acre. The modeling showed the role of the Conservation Units and Indigenous Lands in protecting forests, roads as a factor of attractiveness to new deforestation and showed that the greatest consequence of the 2012 Forest Code is to reduce the protection of fragile areas of transition between terrestrial and river ecosystems with implications for biogeochemical cycles, climate change and human and animal populations that live there.
Resumo: A lei 12.651/2012 que substituiu a lei 4.771/1965 e instituiu o “mais novo” Código Florestal Brasileiro, gerou polêmica acerca da justificativa utilizada para a modificação, dúvidas sobre sua capacidade de proteger as florestas e sobre sua aplicabilidade. Para compreender as implicações e motivos da alteração e estimar as possíveis consequências ambientais e sociais futuras, esta dissertação foi estruturada em três capítulos sendo: o primeiro uma revisão bibliográfica sobre o histórico do Código Florestal, de sua criação até a última substituição ocorrida em 2012; o segundo sobre a delimitação das áreas de preservação permanentes (APPs) ao longo dos cursos d’água e, as consequências ecológicas e sociais das novas definições legais sobre essas áreas, para o município de Boca do Acre, Amazonas; o terceiro, a modelagem do desmatamento em Boca do Acre até 2025 considerados 3 cenários sendo dois contrafactuais que tem como premissas a proibição total do desmatamento dentro das áreas de preservação permanente nas margens de cursos d’agua de acordo com as duas versões da legislação (Código Florestal de 1965 e de 2012) e um cenário linha de base que segue as tendências atuais em relação as taxas de desmatamento dentro dessas áreas. Os resultados mostram que historicamente o Código Florestal sempre esteve atrelado a interesses econômicos e que a lei 12.651/2012 surgiu com o objetivo de legalizar irregularidades cometidas. De fato a nova legislação reduz as áreas protegidas e com isso reduz o passivo ambiental em áreas de preservação permanente em 24% no município de Boca do Acre. A modelagem evidenciou o papel das Unidades de Conservação e Terras Indígenas em proteger as florestas, as estradas como fator de atratividade para novos desmatamentos e mostrou que a maior consequência do Código Florestal de 2012 é a redução da proteção de áreas frágeis de transição entre ecossistemas terrestres e fluviais com implicações para os ciclos biogeoquímicos, mudanças climáticas e para as populações humanas e animais que ali vivem.
